New Jersey town Shutters Blue Water after State Lawsuit
Not in this town, you don’t.
The Township Committee of Egg Harbor, New Jersey officially ordered Blue Water Travel Club to cease operation, after the state of New Jersey announced the filing of a lawsuit against the company and its related businesses for alleged consumer fraud.
The town also denied Blue Water’s application for a mercantile license to operate in the area, and quashed its subsequent appeal. The business opened in February under owner Daryl Turner of Vacation Clubs, LLC, and had an address at 501 Scarborough Avenue. It offers memberships in a discount travel club, and promised free trips to consumers who attended its sales presentations.
Both Turner and Vacation Clubs were named in the state lawsuit, along with his other businesses: Dreamworks Vacation Club, Five Points Travel Company and Bentley Travel. The companies operated out of other towns in New Jersey; Parsippany, Sewell and Westampton (see previous story here).
According to Detective Sgt. Raymond Davis, Blue Water was operating without a mercantile license and was cited twice by the township before Turner finally applied for one.
Davis was assigned to investigate the company during the application, and to judge the business responsibility and moral character of Turner as part of the process. The detective unearthed a history of fraud, deception, and questionable business ethics.
“There just seems to be a common thread with the applicant Darryl Turner for fraud and deception regarding vacation-club-type business,” said Davis during the appeal hearing last June 9. “Based on that, I don’t find him to be free of fraud and I deny the application.”
In the course of his investigation, Davis also found that both the attorneys general of New Jersey and Pennsylvania have civil action pending against Turner for his involvement with travel companies like Blue Water.
Turner’s lawyers said the complaints behind the civil action were mere allegations of fraud, and have yet to be proven. They also said that most of the cases were caused by their mailed advertisement forms, and the company was working to make the advertisements more clear.
However, Davis presented three witnesses to testify during the hearing, all of whom encountered problems at Turner’s Blue Water business in Egg Harbor. Among them was Mary Francis Trabosh, who said she was lured to a Blue Water sales pitch with the promise of a free cruise.
Trabosh was impressed with the presentation and bought a membership in the vacation club for $3,000. But when she tried to redeem her free cruise, she was unable to. “I called the number for the free cruise five times, and all you get is an answering machine saying that they’ll call you back,” she said. “I never got a call back, so there’s really no cruise and no vacation club as far as I’m concerned.”
Norman Pendergrast claimed of similar frustrations after viewing the company’s sales presentation. The pitch painted Blue Water as vacation club able to give exclusive discounts on vacation properties to members. “They were the so-called Wal-Marts or Costcos of the vacation industry.”
Pendergrast and his wife availed of the membership, after being told the company could provide them with plenty of vacation properties in his favorite spot, Myrtle Beach. The couple shelled out $3,795, but when his wife attempted to book a vacation in Myrtle Beach, they were unsuccessful. The property ownerssaid they had never heard of Blue Water, and so could not give any sort of discount.
Another couple, Sidney and Angela Coleman, paid $2,400 for their membership, and an additional $100 to have their previously owned timeshare sold. However, but were unable to reach Blue Water or the resale company promised to sell their timeshare after buying in. “It was a separate company, and we haven’t heard from them since,” Coleman said. “We’ve made numerous attempts to try to contact Blue Water.”
Angela added “No one has a last name in that business. Something’s wrong. We got a card, nobody has a last name. What is that about?”
Turner’s lawyer said their company was not at fault for the poor phone communication Trabosh and the Colemans complained about. He said customers went through a service company recommended to Turner by the New Jersey Attorney General to book their travel plans.
Deputy Mayor Stanley “Jake” Glassey said he did not care if it was a third company handling the calls; Blue Water should be held responsible for ensuring customers satisfaction as the ultimate provider of the marketed services.
Glassey went on to say “Just hearing all this, to me, is disgusting. This is a waste of time.” He said even if Blue Water wasn’t being accused of fraud, the fact that Turner was operating without a mercantile license was enough to determine his character.
“You took these people’s money without even having a license to do it in this town, and that’s wrong and you know it’s wrong,” he said.
Turner and his lawyers insisted that the company was a legitimate operation. They claimed all the complaints against Turner’s various travel companies come from less than one half of a percent of his total customer base.
Turner told the Township Committee that he would like to resolve the situation, and offered all three witnesses full refunds at the close of the hearing.
Meanwhile, the three witnesses are left with the headache of disputing the payments made to Blue Water with their credit card companies.

I also was taken by Blue Water’s sales presentation. It sounded real good at the time but I’m very frustrated with no call backs and no ifo. Can anyone tell me how I can go about getting my money back? I’ve called my credit card company and they told me I need to speak with Blue Water. Good luck trying to contact them…

My husband and I also received an invitation to attend a presentation with Blue Water with a promise of a cruise and 2 free airline tickets for attending. We received comprehensive booklets well presented with details on how to move forward to collect including submitting a postal money order for either airline fees in the amount of $100 or $249 pp money order for cruise dock fees etc.
This was from Promotions located at 1735 Market St., Phildelphia. They list a suite and probably a box # and telephone number as well as email address.
You cannot contact these people and I found that they do not have a suite at the location listed only a post office box where they fraudulently collect peoples money. A person M. Dilliard signed my return certificate for $100.00 but again no one returns calls and nothing has ever been recieved in the mail
as promised.

Me & a friend were also scammed. No free cruise and the travel club is a joke!
No one gives last name or will give you the name of someone in authority to complain to. I’ve asked for a full refund and will keep bothering them until i get it. I’m not going away! Corporate office is in North Carolina-call them @ 828-398-4442. Contact your local news stations and better business bureau and submit complaint with Attorney general’s office.

Yeah, Count me in as well, get this Great offer via post card, sit through the relaxing presentation, get hustled into a cubicle room and them the so called “No Pressure” sales pitch began, “If you take this top of the line offer right now, you will get it for this price” we will even offer you interest fee financing, as long as you are able to put up half down.
Then the nightmares begin, just call the 800# and book your next vacation, The price was more then Priceline.com, what a scam/fraud. would like very much to meet this Turner in a dak alley, but I will hope the Legal System will work this out first, if not, look out turner, a nice alley has your name on it.

Looks like we are still Blue Water landlubbers. According to a recent documentary I saw on TV, most cruise ships are empty because of the poor economy.
I hate to think that I’ve been gyped by these shysters. It appears that I have. It is a glorified travel agency. Heck, I could have used AAA. I should have known it was a scam when the “free” cruise cost $600.00.
Too soon old and too late smart. How do these crooks sleep at night?

Well it looks like my wife and I are not the only ones who keep “chasing the ghost”!!! We went to Atlantic City for a presentation last year (June 2010) and got the same sales pitch. We’ve been trying to get the promo company to make good on the cruise for about two months now, AND CATCH THIS, today (3/2/11) she got thru to “Marie” – NO LAST NAME at the promo office in Phila (actually I think the number rings in Oshkosh Wisconsin!!). Marie told her the promo company ….”actually just went out of business”. Since they have a Phila Penna address do we contact the Pa Attorney General or New Jersey (where we live) Attorney Generals office??? – Has anyone called or do you go “on line”??? Could use some help – msgennaro@comcast.net

My husband and I were swindled as well. Didn’t know until we received our travel date request forms back in the mail as undeliverable. We are trying to get our money back. Any information we get we will pass on and hope the same in return.

OMG! I knew it! We went down to Blue Water in Absecon last Spring and I just tried calling the Promotions office and the phone is no longer in service at the Philadelphia Market St.location…yeh, real surpris!. My Husband John and I are now out $600.00 for the so called airfare & cruise. I sent an email back to yourpromotravel@gmail after they sent John an email telling us we couldn’t get a refund until our promotional trial period was up March 2011. Well March came and went! I demanded a refund in an email yesterday,and we are still waiting for a response and that refund check. I think we all need to call our local news and get these bastards!

My husband John and I were also ripped off of $600 I am very aggreviated with them .We too sent our money to Phil. recived a conf. and then could not get a hold of anyone to book this cruiose ! This company is a definate ripoff And I just wasted $600 of our hard earned money!! I never recieved and email when I asked for our money back !! The only way I will book a cruise is thru a travel agent now!!
